What is Workers’ Compensation?

Workers’ compensation insurance is required by law in Florida for any employers with four or more employees, whether full- or part-time, as well as employers who are in the construction industry. Different businesses have different coverage requirements, depending on the type of industry, number of employees and entity organization.

A workplace injury or illness can cause a worker to lose time from work and the income they would have earned, as well as add the medical expenses they may incur. Workers’ compensation benefits are provided by an employer to cover the costs of any added expenses an employee might incur, such as medical, disability, or death.

What Does Workers’ Comp Cover?

General coverage typically includes:

  • Medical care from the injury or illness
  • Replacement income
  • Costs for retaining
  • Compensation for any permanent injuries
  • Benefits to survivors of workers who are killed on the job

Workers’ comp isn’t just limited to incidental accidents — it also covers problems and illnesses that are developed over a long period of time doing the same injurious activity. Examples of such injuries are carpal tunnel syndrome or back problems from repetitious movement.

What Isn’t Covered by Workers’ Comp?

  • Mental or nervous injury due to stress, fright, or excitement
  • “Pain and suffering”
  • If the injury is caused by:
    • The employee’s willful intention to injure or kill himself or another
    • The employee is intoxicated or under the influence of drugs
